1. About these terms

These terms apply to work carried out by Tree-Volution, owned and run by James Goldring, 5 St. Saviour Close, Colchester, CO4 0PW. Accepting a quote means accepting these terms.

2. Quotes and pricing

The initial site visit and quote are free and carry no obligation. We do not operate a fixed price list, every price is based on the specific tree, hedge or plot, its access and its condition. A quote covers only the work described in it. If the job changes once work begins, or hidden defects or obstructions are found, we will stop, explain the position and agree any revised price with you before continuing.

3. Booking and access

Work is booked for an agreed date. You agree to provide safe access to the site and to move vehicles, garden furniture, pets and anything else that could be damaged or get in the way. Where access runs through a neighbouring property, it is your responsibility to obtain that permission before we attend.

4. Consents and protected trees

You confirm that you own the trees to be worked on, or have the owner's permission. We check for Tree Preservation Orders and Conservation Area status and can prepare and submit applications on your behalf, but work cannot proceed until any required consent is granted. We will not carry out work that would breach a TPO or Conservation Area protection.

5. Weather and rescheduling

Tree work at height is weather dependent. We may postpone a booking for high winds or other unsafe conditions, and will rearrange the earliest practical date. We are not liable for losses arising from a weather-related postponement.

6. Waste and timber

Unless agreed otherwise, waste removal, wood and chippings disposal and recycling are included in the price. Timber you wish to keep must be requested before work starts.

7. Standard of work and guarantee

Work is carried out by qualified operatives to the specification agreed. All concrete and paving (landscaping) work carries a 10-year guarantee. Tree work cannot be guaranteed in the same way, because a tree cannot be put back once it has been cut, but it is carried out to the agreed specification. Any concern should be raised with us before we leave site, or as soon as reasonably possible afterwards.

8. Insurance and liability

Tree-Volution holds public liability insurance of £10 million, details available on request. We are not liable for pre-existing defects, for damage to unmarked underground services, drains or cabling, or for minor unavoidable marking of lawns and soft ground where machinery access has been agreed.

9. Payment

Payment is due on completion unless different terms have been agreed in writing. Invoices are issued for the amount quoted plus any variations you have agreed.

10. Cancellation

Please give us as much notice as possible if you need to cancel or move a booking. Where costs have already been incurred on your behalf, for example a council application fee : those remain payable.
